About Competent Person

Image for this page

The law requires all employers to appoint a competent person in health and safety. More specifically it is a requirement of the Management of Health and Safety at Work Regulations. Regulation 7 requires employers to appoint one or more Competent Person(s) to assist them in meeting their legal obligations. The Regulations also require sufficient resources to be devoted to managing H&S.

So you need to ask yourself does your business have access to health and safety advice that will help to protect your employees and business? And do you feel that the advice is relevant to your business and takes a realistic look at the risks that you face?

It is clear that when it all goes wrong then it is the courts that will decide whether a business has fulfilled its duties or not. Fines over the last 5 years have significantly risen and from 2016 penalties will be even more penal. Significantly for large organisations then the threat of a fine in the millions is a real possibility. Added to this is the very real concern of how negative publicity will affect the business.

What is vitally important is that your business must have access to suitable competent health and safety advice; but where can you find such advice?

This was one of the issues reviewed as part of Lord Young’s Common Sense - Common Safety report. One of the recommendations was for the development of a consultants register. The OSHCR register is now up and operational and initially at MESH we signed up. However with limited publicity many clients still don't know how to find the right support for their business.

We see all too often that not all consultants will have the necessary experience for your business and therefore may not provide you with sensible and proportionate advice to keep your business safe and free from prosecution. At MESH we have a team of consultants with a combined experience of over 100 years and you can be assured to receive the right advice to keep your business legal and safe.

The Management of Health and Safety at Work Regulations 1999 state that a person is competent “where he has sufficient training and experience or knowledge and other qualities to enable him properly” to do the task in question. However, there is no comprehensive and prescriptive definition of what is required. Whilst knowledge can be assessed through formal examinations, skills and experience present a greater problem.

Therefore organisations often find it difficult to appoint persons to adequately fulfil this role.

Our satisfaction guarantee

MESH clients are happy clients and many provide testimonials to this fact. We provide highly professional Health & Safety training & consultancy services that guarantee you will never have to worry about a visit from the HSE. Our guarantee is that if we have provide you with Competent Persons support, in the unlikely event of any negative contact from the HSE, we will be available (free) to support you in your response. All we ask is that you have followed and implemented Health & Safety recommendations that we make as part of our work for you.

Your Options

MESH can offer a range of Competent Person options to meet your organisations needs anywhere throughout the UK, we do however insist that we need to understand your business and your business goals in relation to health and safety:

1. We can undertake an audit of your organisations health and safety compliance and provide you with an action plan and consultancy support plan to implement any necessary improvements.

2. We can supply your organisation with a consultant to lead health and safety within your organisation.

3. We can support your in-house health and safety persons by undertaking scheduled routine compliance checking visits (which could be monthly to as little as 6 monthly).

What we provide is a service that can be tailored to you to enable you to meet legislative health and safety compliance, and keep the HSE inspector satisfied that you have Competent Persons advising you.

Costs of Competent Persons support can vary depending on the type and size of organisations and the range of activities we are requested to carryout for an organisation. We work with large, medium and small size businesses and will often provide a range of options for the organisation to select from.

As a guideline, we have provided organisations with as little as three days support over a 12 month period. We have also on the other end of the scale have provided clients with a person on site for 2-3 days per week over the period of the contract agreed. Because of this our fees have ranged from as little as £1000 to tens of thousands to provide support that meets the individual organisations needs.

Based on our professional standing we believe that our pricing is very competitive but we guarantee never to compromise on quality. You can be assured that our consultants will add valve to your business without costing a fortune that some of our larger competitors charge.

Of course we would expect you to shop around for quotations but would encourage you to check what level of service is being provided.  Ask yourself whether you getting health and safety support that will make a long-term difference to the health and safety of your staff and your business.  If in any doubt, please do contact us without obligation.

Are you really assessing the key risks to your business?

Only recently I delivered an IOSH Managing Safely course to a client and we asked a question to the managers attending:  â€œwhat are the key risks in their business?”.  What came back depended on the area that they managed … Transport risks were uppermost at the site for the logistics and transport guys.  These included […]
